These Terms of Service (“Terms”) govern your access to and use of the VELLUM online store and related services (the “Services”). By visiting the store, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the Services.

Store platform

Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer products and Services to you. Your use of Shopify-powered features may also be subject to Shopify’s applicable terms and privacy practices.

Eligibility and accounts

You must be at least the age of majority where you live, or use the Services with the permission and supervision of a parent or legal guardian. You are responsible for keeping your account credentials secure and for activity under your account. Information you provide must be accurate, current, and complete.

Products and availability

We make reasonable efforts to display product descriptions, colours, sizing, and images accurately. Actual colours may vary by screen, lighting, production batch, and material. Measurements are approximate. Products and quantities may be limited, changed, or discontinued at any time.

Prices and payments

Prices are shown in the currency displayed by the store and may change without notice. Taxes, shipping, duties, and other charges are shown at checkout when applicable. You agree to provide valid payment and billing information and authorize us and our payment providers to charge the total shown at checkout.

Orders

An order confirmation acknowledges that we received your order; it does not guarantee acceptance. We may refuse, limit, or cancel an order for reasons including suspected fraud, pricing or inventory errors, product unavailability, payment issues, or violation of these Terms. If we cancel an order after payment, we will refund the amount charged for the cancelled portion.

Shipping, returns, and refunds

Orders are subject to our Shipping Policy and Return and Refund Policy, which form part of these Terms.

Intellectual property

The Services and their content, including the VELLUM name, logos, graphics, product designs, photographs, text, layout, and software, are owned by or licensed to VELLUM and protected by intellectual property laws. You may use the Services only for personal, non-commercial shopping purposes. No content may be copied, reproduced, modified, distributed, sold, or exploited without prior written permission.

Reviews and submitted content

If you submit a review, photo, feedback, idea, or other content, you confirm that you have the right to do so and that the content is accurate, lawful, and does not violate another person’s rights. You grant VELLUM a worldwide, non-exclusive, royalty-free licence to use, reproduce, adapt, publish, and display that content for operating, improving, and promoting the Services. We may remove submitted content at our discretion.

Acceptable use

You may not use the Services to violate law or another person’s rights; submit false or misleading information; transmit malware or harmful code; scrape, crawl, or interfere with the Services; attempt unauthorized access; engage in fraud; harass others; or misuse the store, checkout, or customer accounts. We may suspend or terminate access for prohibited conduct.

Third-party services and links

The Services may include links to or features provided by third parties. We do not control and are not responsible for third-party websites, products, services, terms, or privacy practices. Your use of them is at your own risk.

Disclaimer

To the fullest extent permitted by law, the Services and all products are provided “as is” and “as available,” without warranties or conditions beyond those expressly stated or required by law. We do not guarantee that the Services will always be uninterrupted, secure, or error-free.

Limitation of liability

To the fullest extent permitted by law, VELLUM and its owners, personnel, affiliates, and service providers will not be liable for indirect, incidental, special, punitive, or consequential loss arising from the Services or products. Where liability cannot be excluded, our total liability will not exceed the amount you paid for the product or order giving rise to the claim. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded or limited.

Indemnity

To the extent permitted by law, you agree to indemnify VELLUM from claims, damages, and reasonable costs arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person’s rights.

Governing law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there, without limiting any mandatory consumer protections available where you live. Courts located in Ontario will have jurisdiction where legally permitted.

Changes and severability

We may update these Terms by posting a revised version with a new effective date. Continued use of the Services after an update means you accept the revised Terms, to the extent permitted by law. If any provision is found unenforceable, the remaining provisions remain in effect.
